1. Who we are

Cakulate ("we", "us") provides this service. These terms cover your use of the Cakulate website and app (the "Service").

2. Your account

Each bakery has its own workspace. You are responsible for the people you invite, for keeping your sign-in secure, and for the information you enter. You must be at least 18 and able to agree to these terms for your business.

3. Free trial

Each new workspace gets one free trial of 7 days with a limited number of AI quotes. To start a trial you add a payment card, which is not charged during the trial. When the trial ends, your subscription to the plan you tried starts and your card is charged, unless you cancel before the trial ends. We may extend a trial, for example in return for answering a survey. One trial is allowed per person and business; we may end trials that are created to get around this. When a trial ends, you need a paid plan to keep using the workspace. Your saved data stays in it.

4. Plans and billing

Paid plans include a monthly number of AI quotes and users; quotes you build without the AI assistant, orders and customers are not limited. Unused AI quotes do not carry over to the next month. Plans are billed in advance monthly, at the price shown when you subscribe. Payments are processed by Square. Plans renew automatically until canceled. You can cancel at any time; access continues to the end of the period you paid for. We do not give refunds for partial periods unless the law requires it. We will give you at least 30 days' notice before a price change takes effect on your plan.

5. Prices you quote are yours

Cakulate is a tool that helps you estimate prices from the rates, times and settings you choose. You decide what to charge your customers and you are responsible for your quotes, orders, taxes and food safety. Estimates and AI suggestions can be wrong; review every quote before you send it.

The quote assistant uses AI. It reads photos and messages and suggests the work, counts and times, using artificial intelligence provided by a third party. AI can misread a photo, miscount details or choose the wrong technique, for reasons outside our control. If it gets a quote wrong, use Report a problem on that quote: your first five reports each calendar month credit that quote back, and if problems continue we will contact you to help. Credits are our only remedy for AI mistakes and have no cash value.

6. Acceptable use

Do not misuse the Service: no attempts to access other shops' data, overload or reverse engineer the Service, extract its pricing methods, or use it for anything unlawful. We may suspend accounts that do.

7. Your data

You own the data you put into Cakulate. You give us permission to store and process it only to run the Service for you. You can export it at any time. Our Privacy Policy explains how we handle it.

8. Availability and changes

We work to keep Cakulate running and improving, but the Service is provided "as is", without warranties of any kind. We may change features over time and will tell you about changes that materially affect you.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or pricing decisions you make, and our total liability is limited to what you paid us in the 12 months before the claim.

10. Ending your account

You can delete your workspace from Settings at any time. We may end accounts that break these terms or go unpaid. These terms are governed by the laws of North Carolina.
